Terms of Service

These terms govern defiance.so, Banger Lab and the associated Defiance APIs and features provided by Defiance Lab Inc, a United States company (“Defiance”, “we”, “us”). They cover browsing forecasts, connecting an X account, submitting calls, entering Fantasy contests and using Banger Lab. By using these services, you agree to these terms. If you do not agree, do not use the services.

1 · Using Defiance

You must be at least 18 and the age of majority where you live, able to enter into an agreement, and permitted by the laws applicable to you to use the service. Do not use Defiance where doing so is unlawful or would require us to violate applicable restrictions. If you act for an organization, you must have authority to bind it.

Defiance forecasts engagement on public X posts and offers trades on recorded outcomes. We set the quotes and resolve results. Pricing and resolution are centrally operated; the USDG pilot records custody and settlement onchain. No part of using it creates a banking, brokerage, advisory, fiduciary or employment relationship.

2 · Your account

Log in with an X account or wallet you control to use account features. You are responsible for securing that account, your device and your Defiance session, and for activity you authorize. Do not impersonate others, sell access, share sessions to evade limits or create multiple accounts to obtain additional grants or manipulate contests.

Privy manages X and wallet login. Signing in does not transfer funds or place a trade. Your private portfolio shows the connected wallet’s cash, open trades and results. Blockchain transactions remain public. Logging out does not cancel accepted trades or remove transaction records.

7 · Manipulation and fair play

We monitor unusual view and trading activity. Alerts flag markets for review and do not automatically cancel trades.

Do not buy or manufacture views, coordinate artificial engagement, use bots or account farms to influence results, collude on contests, exploit collection delays, or knowingly enter a call whose outcome you are manipulating. Do not evade an investigation or restriction through another identity. Ordinary sharing of a post is not, by itself, evidence of manipulation.

Detection and review can be imperfect. We may pause affected markets while reviewing evidence, cancel related entries, suspend accounts involved in abuse, and review affected results under their accepted settlement rules. Reports of suspicious activity are not themselves proof that a creator or participant acted improperly.

8 · Forecasts and Banger Lab

Forecast curves, probabilities, badges, creator comparisons, explanations and draft scores are experimental estimates. They may be inaccurate, uncalibrated, incomplete or based on stale or limited observations. A probability is not a promised outcome, a prediction interval is not a guarantee, and past model performance does not establish future accuracy. Banger Lab’s draft model differs from the engagement forecasting model used for call probabilities.

Banger Lab processes text and optional quote context you submit when you select Analyze. AI providers help produce the response. Explanations may be wrong; a sensitivity to wording is not proof that editing those words will cause a gain. Do not submit secrets, sensitive personal information or material you do not have authority to share with the service and its processors.

Use your own judgment before relying on or publishing output. Nothing on Defiance is financial, investment, legal or tax advice, an offer to buy an asset, or a promise of reach, revenue or profit. You remain responsible for your posts and decisions.

9 · Content and intellectual property

Public posts, names, avatars and quoted material belong to their respective rights holders. Defiance does not acquire ownership of your drafts or your X posts. By submitting material, you confirm you have the necessary rights and grant us a non-exclusive permission to process, reproduce and transmit it as needed to provide the requested feature, operate and secure the service, and comply with law, as described in our Privacy page. This is not a transfer of ownership or a promise to keep third-party copies confidential.

Our interfaces, branding, original materials, compiled datasets and software are protected by applicable rights belonging to us or our licensors. You may use the service for its intended purposes subject to these terms. Open-source components retain their own licenses. Do not remove attribution, impersonate our brand, redistribute private account information or claim that Defiance endorses your work. You may share your own results accurately without implying certainty or ownership of other people’s content.

10 · Privacy and external services

Our Privacy page explains account information, public records, collected post data, browser storage, notifications, optional analytics and draft processing. Using Defiance does not automatically opt you into optional analytics. Browser notification delivery depends on your permission, browser and device.

X sign-in, public X content and counters, image hosting, cloud infrastructure, analytics when enabled, and AI processing rely on independent services. Their terms also apply to your dealings with them. We do not control their availability, moderation, counters or policies, and links do not imply endorsement. Defiance is not operated by or affiliated with X. Deletion or revision at a source may not immediately remove previously captured observations from our dataset.

11 · Acceptable use

Do not use the service for fraud, harassment, infringement or other unlawful activity. Do not steal sessions or credentials, access another user’s private records, bypass authentication or rate limits, overload the API, introduce malicious code, or exploit errors to obtain balances or results. Do not resell access or use automated clients to evade published limits or fairness controls. Report vulnerabilities privately and stop using an exploit once discovered.

We may apply reasonable access controls and usage limits to protect users, costs and reliability. Cooperation with an investigation does not require you to disclose your X password, private keys or unrelated credentials.

12 · Changes, suspension and termination

We may change features, models, pricing policies for future entries, availability or limits for future trades. We may pause or discontinue the service, including for maintenance, integrity concerns or legal requirements. Material updates to these terms will carry an updated date and, where reasonably practicable, a notice in the service. New rules do not silently reprice previously accepted entries; corrections and integrity reviews are addressed above.

You may stop using Defiance at any time. We may restrict or terminate access for a material breach, abuse, security risk or legal requirement, and may act immediately where necessary. Where practicable, we will explain the reason and allow you to raise an error. Provisions concerning existing records, intellectual property, liability and disputes continue as needed after use ends.

13 · Responsibility and liability

To the extent allowed by law, Defiance is provided as available, without a promise of uninterrupted access, error-free models, perfectly accurate data or fitness for a particular purpose. We do not guarantee the availability of a future product. These limits do not remove any warranty or protection that the law does not allow us to exclude.

To the extent legally permitted, we are not responsible for indirect or consequential losses, lost profits, lost opportunities, reputational loss or loss caused by reliance on forecasts, external counters or third-party services.

Nothing excludes liability for fraud, deliberate misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited. Mandatory consumer and data-protection rights remain intact.

Where permitted by applicable law, you are responsible for reasonable third-party claims and direct costs caused by your unlawful submissions, deliberate abuse or material breach of these terms. This does not require you to cover losses caused by our own misconduct. We will give reasonable notice of such a claim and will not settle it in a way that imposes an obligation on you without your agreement.

14 · Questions, disputes and general terms

For a result review, account issue, rights complaint or question about these terms, email Defiance Lab Inc at [email protected]. Include the relevant post, entry or round identifier and enough detail to investigate; never send a password or session token. We will seek to resolve disputes in good faith. This does not prevent you from exercising rights through a competent court or regulator.

These terms do not impose mandatory arbitration or a waiver of non-waivable consumer remedies. Applicable law and the competent courts are determined under the rules that apply to the parties and the dispute. If a provision is unenforceable, the remaining provisions continue to apply so far as legally possible. A delay in enforcement is not a waiver.

These terms, the Privacy page and the specific rules disclosed for an accepted entry form the agreement for using Defiance. An accepted receipt governs that entry’s numerical terms. You may not transfer your account or obligations to evade these terms. We may transfer operation of the service as part of a reorganization or sale, subject to applicable law and existing user rights. USDG trades and balances are governed by the custody and settlement mechanics described above.
